In Germany there are up to now only few decisions dealing with the topic
copyright infringement in the www. Two of them you can find online:
http://www.netlaw.de/urteile/index.html#Urheberrecht
- Landgericht Duesseldorf, http://www.netlaw.de/urteile/lgd_3.htm .
As conclusion of that decision from copyright point of view, sites,
which only contain a simple (difficult to define) showing of products,
do not necessarily reach the height to be a work in the sense of german
copyright law.
- Landgericht Koln, Another decision of the LG Koln says, that
a collection of 251 hyperlinks is a database and protected by
copyright law. This decision is only publicated in the main
sentences but should be based on the EU-directive
(http://www2.echo.lu/legal/en/ipr/database/database.html)
concerning databases and the transformation of that directive in
German copyright law realised at the beginning of 1998. See:
http://www.netlaw.de/urteile/index.html#Urheberrecht
