I believe that your MiniDisc recorder complies with the SCMS requirements of section 1002 and the requirements for royalty payments in section 1003. Diamond's position is that these provisions do not apply to their Rio device.

In the interest of full disclosure, my employer is a competitor of Diamond Multimedia, the defendant in this suit, although not with respect to this MP3 device.
