European Copyright Law

The heirs of a recording artist have indicated that live recordings of the artist's performances in Europe were made prior to 1990. The heirs say that they have heard that making such recordings without the artist's permission was legal before 1990 under "European" law and that the law changed in 1990. Does this sound familiar to anyone? I have been researching various sources like International Copyright Law and Practice by Geller and Nimmer, but can't seem to pinpoint any information on this topic. I'm trying to figure out if the heirs are right about pre-1990 recordings of live performances, whether any change in the law effecting post-1990 recordings might have retroactive effect and whether the pre-1990 recordings can be lawfully distributed outside of Europe. Any help or leads would be greatly appreciated.
