For those who want an easier link to the Bender and Hyperlaw v. West decision, check the Touro Law School - Second Circuit website:

Both decisions are listed. At least in the 2d Circuit, publishers such as Hyperlaw will be able to add the West Reporter volume # and pagination to court decisions in their legal products (such as CD-ROMs).

Although some federal courts are starting to put their opinions on their own home pages, none appear to be adding the West pagination or volume numbers once that data becomes available. Nor do the law schools who post federal court opinions seem to be doing this updating.

This seriously limits the value of these free Internet sources for court opinions, since attorneys need the pagination/volume in order to cite to a case in a court pleading or a legal publication. Perhaps the Bender decision will encourage these web sites to incorporate this data.
