There is one other possibility. The domain name registrant may decide not to pay the fee to renew the domain name (indeed, why would he want to pay for a domain name he can no longer use?). In that case, the registration will eventually be canceled for nonpayment, at which point it will again become available to the public. If the challenger has pleaded his case with NSI correctly, he may be able to get "first dibs" on registering the domain name once it becomes available.
