I don't think you're missing anything, but perhaps Ibbotson Associates are. Perhaps they simply want credit for having first found that statistic and have confused that with ownership(?).
Recently someone at Hartford Life claimed our company was violating their "patent" on a certain type of life insurance. Mind you there was no software or anything involved. Certainly copyright issues can and have been raised regarding similar wording in insurance policies, but you can't own a concept. You can't own a singular statistic either which is what 10.5% sound like to me.
