Marvel is a separate company, a subsidiary of Marvel Enterprises, Inc. The writer is confusing it with DC comics. Permissions are handled at 387 Park Avenue, New York. Do not confuse Superman and SpiderMan: Marvel is SpiderMan, Fantastic Four, XMen, etc. And permissions from that company are essential if you plan to use its property!
