No doubt prompted by recent discussions on this list, the California Supreme Court this week granted review in Comedy III Productions, Inc. v. Gary Saderup, Inc. This case involves whether prints and T-shirts bearing a likeness of the Three Stooges, based on a sketch by Mr. Saderup, violated the Three Stooges' right of publicity under California Civil Code Section 990, and whether the application of Section 990 to bar distribution of the prints and T-shirts would violate the First Amendment. The lower courts held in favor of Comedy III.
