To add a few more details for Patrick Begos to those already noted by other correspondents on the list:

A report by Constance Hayes, NY Times Service, published in the Toronto Globe and Mail, Sept.28, 1991, stated that Jeff Koons "sent a greeting card that he had bought in an airport gift shop to his workers in Italy, telling them that the sculpture 'must be photo' on the card". Three copies of the resultant scupture sold for a reported $367,000 USD (in total). The photograph was Art Rogers', a photographer in California at the time. The initial federal court ruling (the report I have does not give the circuit) took place in December, 1990, and was then appealed by both sides -- in Rogers' case, because of the matter of damges awarded.
