copying and fair use

I would appreciate hearing from anyone on the list with regard to the following questions we have - please reply to me by e-mail.

  1. If an institution owns only a copy of an original manuscript held by another institution or by an individual, can it make fair use copies for a third party? Does it make any difference how we got the copy
    (donated by faculty member who used it in his/her research or purchased
    for our collection because it supports a program area)?

Follow up question:

Should we accept copies of research materials at other institutions made by faculty members at our institution to add to our manuscript collection? Should we destroy material like this we already own?

2. Are there any restrictions on making copies of nineteenth manuscripts owned by an institution but for which it has no deed of gift? What if we have a record that we purchased the items?
