A "fact specific" law with very unclear principles is a law made, piece by piece, in court and not in Congress, which, if it does its job, is supposed to make the law.

As for the role of IP lawyers: most lawyers spend most of their time out of court, not in it. Every university has one or more lawyers on its staff or available for consultation; likewise, major publishers. Many author guidelines on fair use say, if in doubt, consult a lawyer. Such a consultation does not, thank God, cost $250,000.
