When I teach my licensing class, on the first day, I bring in a can of Guinness stout, and invite the students to suggest what IP might be present in the product. The answers I hope for are trade secret and know-how in the beer, copyright in the label, trademark and trade dress in the can, and patent in the can function (U.S. patent no. 4,832,968).
