Paul Heald and Michael Wells have written an excellent review in Washington and Lee Law Review (1998) on Misappropriation of Intellectual Property by State and Municipal Governments Before and After Seminole Tribe: The Eleventh Amendment and Other Immunity Doctrines.
Would anyone like to discuss it in part or in whole? I have finished a first reading and it is not easy to understand in parts. Not because of the writing, but because of the complexity of the issues, eg., parallel actions in state and federal courts.
