An important and long awaited decision was released today by Canada's Copyright Board regarding liability for public performance or "communication to the public by telecommunication" of music in the Internet context. This involves the proposed "Tariff 22" filed by SOCAN, Canada's musical performing rights society, in 1995. This preliminary "Phase I" decision deals only with broad legal issues, i.e. "which actions trigger liability under the [Copyright] Act and which do not".
