Hotmail Corp. v. Van Money Pie Inc., 47 U.S.P.Q.2d (BNA) 1020, 1998 U.S. Dist. LEXIS 10729 (N.D. Cal. 4/20/98). I don't know of a free online source for the text of this opinion, though there may be one.
