Hypothetical: An author visits a group and reads from his works; his appearance is videotaped. The author is aware of the taping, but there is no discussion of what is to be done with it. The group then puts the video on its website. Do we have infringement problems? Is the infringement of the works (if not eligible for fair use defense) or of only the author's performance in reading them?
